Property title check
Initially, each prospective buyer, through an experienced agent, must check the legal status of the property at the competent local Land Registry (checking property titles). Disclaimer of Inheritance
This is essentially a declaration by the temporary heir that he does not accept the inheritance, i.e. that he does not wish to become the final heir. The declaration is made before the registry of the Magistrate’s Court in the district where the heir had his or her residence or domicile at the time of death, and within a period of four (4) months from the time the heir became aware of the induction. However, if the heir resides abroad or learned of the induction while residing abroad, then the said period shall be extended for one (1) year.
However, the handling of the case is different when a renunciation of inheritance by minors must also take place.
In this case, the procedure of renunciation of the inheritance of a minor child is carried out by his/her parents after special permission granted by a court decision. The application shall be filed at the seat of the locally competent Magistrate’s Court in whose district the minor resides.
The time limit for this remains four months, unless it falls within one of the exceptions mentioned above.
